DMCA Policy

ByteDisk ("we," "us," or "our") is an Online Service Provider under Title II of the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). This document outlines the policy that ByteDisk has implemented to comply with the notice and takedown procedures required by the DMCA.
ByteDisk respects intellectual property rights and complies with the DMCA. We respond promptly to claims of copyright infringement reported to our designated copyright agent. ByteDisk shall not interfere with standard technical measures used to identify and protect copyrighted works and shall disable access to or remove content that we believe in good faith may infringe the copyrights of third parties, as well as discontinue service to users who repeatedly make infringing content available.
1. ByteDisk's Approach to Content
1.1 No Automatic Indexing
ByteDisk is technically unable to automatically index or pre-screen the content being uploaded or stored on its servers. Content moderation occurs only in response to user uploads and copyright notices.
1.2 Content Privacy
ByteDisk considers uploaded content to be private and confidential unless the user has made it public or shared it. We do not monitor or review content unless notified of a potential violation.
1.3 No Authority to Judge Content
Without a distinct copyright owner's notification or legal authority, ByteDisk has no authority to make judgments on whether each user is competent to upload content (e.g., whether such user is the copyright owner, authorized proxy of the owner, whether the content is uploaded for personal use, whether the copyright has expired, or if the content qualifies as fair use). Any content is considered consistent with our Terms of Service unless otherwise notified by the copyright owner or authorized person.
2. Filing a DMCA Notice
If you believe that any material on ByteDisk infringes upon a copyright you own or control, you may file a DMCA notice with our Designated Agent.
2.1 Required Information
A valid DMCA Notice must include:
- Your identification: Identify yourself as the copyright owner or a person authorized to act on behalf of the copyright owner. Include your physical address, phone number, and email address. If acting on behalf of the owner, describe your relationship (e.g., attorney, agent).
- Description of copyrighted work: Identify the copyrighted work(s) that you believe is/are being infringed.
- Identification of infringing material: Identify the material(s) allegedly infringing your copyright by providing the specific URL(s) on ByteDisk that contain these material(s).
- Statement of good faith belief: State that you have "a good faith belief that use of the aforementioned material is not authorized by the copyright owner, its agents, or the law."
- Accuracy statement: State that "the information in this notice is accurate, and under penalty of perjury, that I am authorized to act on behalf of the owner of an exclusive right that is believed infringed."
- Signature: Your physical signature (if submitting in paper form) or electronic signature (if submitting electronically).

Note: Messages, including DMCA notices, are accepted as plain text. Attachments are not opened due to security reasons and will only be processed if requested by us.
3. Notice and Takedown Procedure
Upon receiving a valid DMCA Notice from our Designated Agent, or when ByteDisk becomes otherwise aware that copyright rights are infringed, we will:
- Remove or disable access to the allegedly infringing material as soon as possible (generally within 24-48 hours of receipt of a valid notice).
- Notify the user whose content was removed, providing information about the notice and the opportunity to file a counter-notice.
- Preserve evidence and information that may be relevant to the dispute.
4. Counter-Notification
If you believe your content was removed in error, you may file a counter-notification with our Designated Agent. Your counter-notification must include:
- Your name, address, phone number, and email address.
- The URL(s) of the removed content.
- A statement that you have a good faith belief that the content was removed in error.
- A statement that you consent to jurisdiction of the federal court in your judicial district (or if you are outside the U.S., that you consent to jurisdiction of any U.S. federal court).
- Your physical or electronic signature.
Upon receipt of a valid counter-notification, ByteDisk will provide it to the original claimant. If the claimant does not notify us within 10 business days that they have filed a lawsuit seeking an injunction against you, we will restore the content.
5. Repeat Infringers
In accordance with the DMCA, ByteDisk will terminate the accounts of users who are determined to be repeat copyright infringers. We will exercise this right in our sole discretion and in circumstances we deem appropriate.
6. Child Safety
ByteDisk does not tolerate child sexual abuse material (CSAM) or any content involving the exploitation or abuse of minors. If you discover such content on ByteDisk:
- Do not download, share, or engage with the content.
- Report it immediately to contact@bytedisk.net with the specific URL(s).
- Also report it to the National Center for Missing & Exploited Children (NCMEC) at CyberTipline.org.
Upon notification, ByteDisk will immediately:
- Remove the content and disable access.
- Terminate the account of the user who uploaded the material.
- Report the matter to law enforcement and appropriate child protection authorities.
- Preserve all evidence for investigation.

9. Changes to This Policy
ByteDisk reserves the right to update this DMCA Policy at any time. Changes will be effective upon posting to this page. Your continued use of ByteDisk after any changes constitutes your acceptance of the updated policy.
