These Terms of Service ("Terms") govern your use of ByteDisk's websites, APIs, and mobile applications (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

ByteDisk provides cloud video hosting for creators: you upload videos, receive shareable links (for example on bytedisk.net), and viewers can watch in our mobile apps. Features, limits (such as maximum file size and supported formats), and availability are described on our site and in your dashboard and may change over time.

2. Eligibility and accounts

You must be old enough to enter a binding contract where you live. Publisher accounts require a valid email and accurate profile information. You are responsible for safeguarding your password and for activity under your account. Notify us promptly of unauthorized use.

3. Your content

You retain ownership of videos and other content you upload. You grant ByteDisk a worldwide, non-exclusive license to host, store, reproduce, transcode or generate previews as needed, stream, and distribute your content solely to operate and promote the Service (including showing it to end users and displaying titles, thumbnails, and statistics you choose to make public).

You represent that you have all rights necessary to upload and monetize your content, and that it does not violate law or third-party rights. You must not upload malware, unlawful material, content that infringes intellectual property, or content that is harassing, hateful, or sexually exploitative of minors. We may remove content or restrict accounts that violate these rules or our policies.

4. Views, earnings, and payouts

Monetization is based on counted views according to our rules: we apply minimum watch time, session deduplication, daily limits per network and device, and other anti-fraud measures. Not every play results in a counted view. The current earn rate is USD $2.50 per 1,000 counted views, subject to change; we will communicate material changes as appropriate.

You may request a payout when your available balance reaches the minimum threshold (currently USD $10) using supported methods such as UPI, Binance, bKash, or Nagad (availability may vary by region). You are responsible for providing accurate payout details and for any taxes on amounts you receive. Payouts are processed in line with our verification and fraud checks; timing and eligibility may vary. We may withhold or reverse earnings in cases of chargebacks, fraud, or violation of these Terms.

5. Advertising

Our mobile apps may display third-party advertisements served by Google and similar partners. Those partners may collect or access device identifiers and usage data under their own policies. See our Privacy Policy for details.

6. App stores

If you obtain our app through Google Play, the App Store, or another distributor, you also agree to that distributor's applicable terms. The distributor is not responsible for the Service except as required by its own terms.

7. DMCA and copyright

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please see our DMCA Policy for detailed information on how to file a notice. We may remove or disable access to material in appropriate cases and may terminate repeat infringers.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEDISK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BYTEDISK AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US (IF ANY) FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

10. Indemnity

You will defend and indemnify ByteDisk against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate your access to the Service at any time for conduct that we believe violates these Terms, creates risk, or is unlawful. You may stop using the Service at any time. Provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnity) will survive termination.

12. Changes

We may modify these Terms by posting an updated version on our website. If changes are material, we will provide additional notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.

13. General

These Terms constitute the entire agreement between you and ByteDisk regarding the Service and supersede prior agreements on this subject. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
